Claims on Biocidal Products – EU Ruling
On 20 June 2024, the EU Court of Justice issued a ruling against a German distribution chain following a dispute with the German Association for the Fight against Unfair Competition regarding the description of a biocidal product in its advertising.
This ruling further clarifies the limitations of claims that can be used on biocidal products, establishing that the claim “gentle on the skin” referring to the biocidal product falls within the formulas of misleading and therefore prohibited advertising.
